These terms are an agreement between you and WINTERHILL MEDIA LLC (“we,” “us”) covering the Vineyard Vibes mobile game (the “Game”). By downloading or playing the Game, you agree to them. If you don't agree, don't play—we'd rather you were sure.
1. Your license to play
We grant you a personal, non-exclusive, non-transferable, revocable license to install and play the Game on Apple devices you own or control, for your own entertainment and not for any commercial purpose. This is a license, not a sale—the Game and everything in it remains ours.
2. Virtual items
The Game includes virtual items such as coins, boosters, and lives. Some are earned by playing; some can be bought.
- Virtual items have no real-money value. They are a license to a feature inside the Game, nothing more.
- They cannot be redeemed, exchanged, or cashed out for money or anything of value outside the Game, and cannot be transferred or sold to anyone else.
- We may change, rebalance, add, or discontinue virtual items and their prices at any time as part of operating the Game. We tune the game continuously; that's part of what keeps it fun.
- Unused virtual items have no cash value and are not refundable, except where a refund is required by law or granted by Apple.
- Virtual items are forfeited if the Game is discontinued or your license is terminated under these terms.
3. Purchases and refunds
All purchases are processed by Apple through the App Store, under Apple's terms and your Apple Account. We never receive your payment details. All purchases are final. If you believe a purchase was made in error, request a refund from Apple at reportaproblem.apple.com—Apple alone decides App Store refunds; we have no ability to issue them ourselves.
The “No Interstitials” purchase is a one-time non-consumable: use Restore Purchases (in Settings and in the Shop) to recover it on a new device.
Prices shown in the Game are provided by the App Store in your local currency.
4. Fair play
Don't break the Game or ruin it for others (or for yourself, honestly). You agree not to:
- cheat, use exploits, bots, or automation;
- tamper with, modify, decompile, or reverse-engineer the Game or its save data, except where the law expressly permits it;
- interfere with the Game's services, ads, or purchase mechanisms, or misrepresent purchases;
- use the Game to violate any law.
5. Availability, updates, and changes
The Game is provided free (with optional purchases) and we work on it constantly. We may update, change, suspend, or discontinue the Game or any feature at any time, with or without notice. Some settings (like difficulty tuning and event schedules) are adjusted remotely without an app update. Updates may be required to keep playing. We are not liable for the Game being temporarily unavailable—sometimes the ferry doesn't run.
6. Termination
You can stop using the Game at any time by deleting it. We may suspend or terminate your license if you materially breach these terms (for example, by cheating or tampering). On termination, your license to the Game and all virtual items ends. Sections 2, 7, 8, and 9 survive termination.
7. Ownership
The Game—its code, art, music, level designs, names, and all content—is owned by us or our licensors and is protected by copyright, trademark, and other laws. “Vineyard Vibes” and the Game's original art and characters are ours. You get no ownership rights by playing or purchasing. Locations in the Game are a fictionalized, affectionate rendition of Martha's Vineyard; no affiliation with any real business or organization is implied.
8. Disclaimers
THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. We don't promise the Game will be uninterrupted, bug-free, or that saved progress will never be lost (we try very hard, and iCloud sync helps, but back up your device).
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROGRESS, OR VIRTUAL ITEMS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE GAME IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US THROUGH THE GAME IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) FIFTY US DOLLARS ($50). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you; nothing here limits liability that cannot lawfully be limited, and nothing here affects your statutory rights as a consumer.
10. Apple's role
These terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for the Game and is not responsible for addressing any claims relating to it. Apple is a third-party beneficiary of these terms and may enforce them against you. You represent that you are not in a country subject to a U.S. government embargo and are not on any U.S. government restricted-party list.
11. Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Massachusetts, and you consent to their jurisdiction—except that consumers in other jurisdictions keep any mandatory rights and venue protections their local law provides.
12. Changes to these terms
We may update these terms from time to time. The current version always lives at this URL, with the effective date at the top. Material changes will be noted in the app's release notes. Continuing to play after a change means you accept the updated terms.
